1. Educational Disclaimer

1.1 Study Aid Only

DriveReady NZ is a supplementary study aid for individuals preparing for the New Zealand Class 1 Learner Licence theory test. It is not a substitute for the official New Zealand Road Code published by Waka Kotahi NZ Transport Agency, and does not constitute legal advice or formal driver training.

1.2 No Guarantee of Results

We make no warranty, express or implied, that use of the App will result in you passing any official examination. Passing the NZTA theory test requires independent study of official materials.

2. Intellectual Property

2.1 Limited Licence

We grant you a personal, non-exclusive, non-transferable, revocable licence to use the App for non-commercial, private study purposes on a device you own or control.

2.2 Our Content

All software, user interface designs, original educational content, gamification systems, achievement badges, and associated materials are the exclusive property of Driver Ready New Zealand Limited and are protected by applicable intellectual property laws. No portion of the App may be reproduced in any form without our written permission.

2.3 Third-Party Content

Questions and road rules within the App are based on the NZ Road Code. Where applicable, copyright is attributed to the Crown or Waka Kotahi NZ Transport Agency. DriveReady NZ is not endorsed by, affiliated with, or sanctioned by the NZTA.

3. Acceptable Use

You agree not to:

• Reverse engineer, decompile, or attempt to extract the source code of the App.
• Use automated scripts, bots, or scrapers to extract content or question data.
• Manipulate the App's systems (for example, bypassing heart cooldowns via device clock changes).
• Impersonate any person or entity within the App.

We reserve the right to suspend or terminate your access to the App without prior notice if you breach these Terms or engage in conduct we determine is harmful to the App or its users.

4. Hearts System

The App uses a Hearts system to structure study sessions. One heart is deducted per incorrect answer in certain modes, and hearts regenerate over time. We reserve the right to modify regeneration rates, maximum capacity, and related rules at any time.

5. System Requirements and Connectivity

Use of the App requires a compatible device and, for features such as progress synchronisation and leaderboards, an active internet connection. You are responsible for any data charges incurred through your network provider. System requirements may change from time to time, and keeping the App updated is your responsibility.

7. Limitation of Liability

To the maximum extent permitted by New Zealand law, including the Consumer Guarantees Act 1993, we shall not be liable for any indirect, incidental, or consequential damages, loss of data or progress due to device or server issues, or any damages arising from real-world driving incidents. The App does not teach physical driving skills.

8. Indemnification

You agree to indemnify and hold harmless Driver Ready New Zealand Limited and its directors, employees, and contractors from any claims, damages, or expenses (including reasonable legal fees) arising from your breach of these Terms or your misuse of the App.

9. Governing Law

These Terms are governed by the laws of New Zealand. Any disputes arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the New Zealand courts.

10. Amendments

We may update these Terms from time to time. The current version is always available within the App. Continuing to use the App after an update takes effect means you accept the revised Terms.

11. Severability and Waiver

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect. Our failure to enforce any right or provision of these Terms does not constitute a waiver of that right.
